Terms of Service
These terms govern BikeBus.club accounts, club participation, ride coordination, content, and the practical responsibilities that come with community-led bike bus activity.
BikeBus.club provides coordination tools. It is not a transportation provider, childcare provider, custody provider, emergency service, insurer, or substitute for household judgment. Children may not create accounts or log in directly.
1. Agreement To These Terms
These Terms of Service ("Terms") govern your use of BikeBus.club, including bikebus.club, our web app, mobile app, admin tools, and related services. By using BikeBus.club, you agree to these Terms and our Privacy Policy.
2. Who We Are
BikeBus.club LLC ("BikeBus.club," "we," "us," or "our") provides coordination tools for local bike bus communities. BikeBus.club is not a transportation provider, school bus service, childcare provider, custody provider, emergency service, insurer, or substitute for parent, guardian, organizer, volunteer, school, municipal, or local legal judgment.
3. Who May Use BikeBus.club
You must be at least 13 years old to use BikeBus.club, and you must be old enough to form a binding agreement where you live. Children may not create BikeBus.club accounts, log in directly, or submit information directly. If you provide rider information, you represent that you are a parent, guardian, caregiver, or authorized household adult with permission to do so.
4. Accounts
You are responsible for keeping your account information accurate and secure. You are responsible for activity under your account. You must not impersonate another person, create accounts for unauthorized users, or provide false household, rider, emergency, or acknowledgement information.
5. Local Clubs And Ride Participation
BikeBus.club helps local clubs coordinate routes, rides, RSVPs, volunteers, communications, and ride-day operations. Local bike bus activity may be parent-led, guardian-led, volunteer-led, school-supported, or community-led depending on the club.
Following a club, joining a club, RSVP'ing for a ride, or using BikeBus.club does not by itself create a transportation contract, custody arrangement, guaranteed supervision arrangement, or assumption of liability by BikeBus.club, a school, an organizer, a volunteer, a municipality, or a local partner.
You are responsible for deciding whether each ride, route, stop, rider, bike, helmet, equipment, weather condition, traffic condition, supervision plan, and local operating model is appropriate for your household.
6. Safety And Assumption Of Risk
Bicycling, walking, rolling, group travel, public streets, paths, intersections, traffic, weather, equipment, and volunteer-led activities involve inherent risks. BikeBus.club may provide planning, communication, route, RSVP, attendance, live-location, and safety-reporting tools, but it cannot eliminate those risks or guarantee safety, route quality, volunteer availability, attendance accuracy, arrival time, or emergency response.
7. User Responsibilities
You agree to provide accurate account, household, rider, emergency contact, RSVP, and safety information; keep rider readiness, equipment, medical, accessibility, pickup, and supervision information current; follow applicable laws, traffic rules, school rules, organizer instructions, and ride-day safety expectations; use live location and operational information only for legitimate ride-day coordination and safety; and respect the privacy and safety of riders, families, organizers, and volunteers.
8. Acceptable Use
You may not use BikeBus.club to harass, threaten, abuse, stalk, exploit, mislead, spam, scrape, compromise security, upload unlawful content, expose private rider or household information, interfere with ride operations, or use operational data for unrelated purposes.
We may remove content, restrict access, suspend accounts, or notify appropriate parties if we believe there is misuse, safety risk, legal risk, or violation of these Terms.
9. Content
You are responsible for content you submit, including posts, comments, attachments, route notes, and safety reports. You grant BikeBus.club permission to host, process, display, and share that content as needed to operate the service. Do not upload content unless you have the right to do so and it is appropriate for the relevant club or ride context.
10. Communications
BikeBus.club may send service emails, account notices, ride reminders, safety updates, support responses, and other operational communications. BikeBus.club does not use SMS at this time.
11. Third-Party Services
BikeBus.club may rely on third-party services for hosting, authentication, maps, analytics, communications, monitoring, storage, and support. Those services may be subject to their own terms and policies.
12. No Professional Advice
BikeBus.club may display route, safety, training, planning, or operational information. This information is for coordination and educational purposes only. It is not legal, medical, transportation, engineering, traffic-control, emergency, or insurance advice.
13. Disclaimers
BikeBus.club is provided "as is" and "as available." To the fullest extent allowed by applicable California and U.S. law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, safety, and error-free operation.
14. Limitation Of Liability
To the fullest extent allowed by applicable California and U.S. law, BikeBus.club and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, personal injury, property damage, ride delay, route conditions, volunteer conduct, third-party conduct, or local club operations arising from use of the service.
Where liability cannot be excluded, liability will be limited to the maximum extent permitted by law.
15. Indemnity
You agree to defend and hold BikeBus.club harmless from claims arising from your misuse of the service, violation of these Terms, unlawful content, inaccurate information, or participation in local activity, except where prohibited by law.
16. Disputes
Before filing a formal claim, you agree to contact us at team@bikebus.club and try to resolve the dispute informally. If we cannot resolve the dispute informally, disputes will be handled in the state or federal courts located in California unless applicable law requires a different forum.
Recommended launch approach: use this court-based dispute clause unless counsel recommends adding mandatory arbitration. Arbitration language can materially affect user rights and enforceability, especially for consumer and family-facing services.
17. Governing Law
These Terms are governed by applicable California and U.S. law, without regard to conflict-of-law rules.
18. Termination
You may stop using BikeBus.club at any time. We may suspend or terminate access if we believe you violated these Terms, created risk, or misused the service.
19. Changes
We may update these Terms. If changes are material, we will provide reasonable notice. Continued use after changes means you accept the updated Terms.
